Avoiding a Legal Hassle

A legal hassle that is easy to avoid…  fellow BNI member Atty. Alison Piasecki related a  story  of a death in a family that become needlessly complicated.  A husband died with a will in place that required the surviving spouse to take various actions for the estate plan to function as the husband intended.  Before the estate could be settled, the surviving spouse suffered severe health complications and was deemed to be incompetent.  The estate now incurs needless expenses and delays because the surviving spouse is incompetent and cannot take the required actions.

 

The solution is simple:  In advance, make sure the estate documents include a broad Power of Atty. giving a trusted person the power to act in the event a surviving spouse cannot.   Are you comfortable that your estate is set up to meet your wishes?
